In a recent court ruling, Zhou Moumou and Qian Moumou, who served as special equipment safety coordinators in Shanghai's Songjiang District, were found guilty of dereliction of duty. Their failure to properly fulfill their responsibilities led to the use of faulty equipment, resulting in one fatality. The Shanghai Songjiang District Procuratorate brought charges against them, and the court has now issued its verdict.
On April 8, 2012, at 11:45 AM, employees of a local grocery company, Guo Moumou and Li Moumou, were using a wire rope electric hoist to lift a steel plate. During the operation, the hanging basket became stuck on the third floor. Guo Moumou attempted to move the basket up and down using the controller, but failed to resolve the issue. Li Moumou then climbed into the basket to try and fix the problem. Suddenly, the basket fell, sending Li Moumou plummeting to the ground on the first floor. He was later pronounced dead after unsuccessful resuscitation efforts.
The incident involved a hoisting device that had already been flagged as illegal. In 2007, the Shanghai Municipal Bureau of Quality and Technical Supervision issued a directive stating that hoisting equipment installed in fixed shafts was considered non-compliant. Then, in September 2009, the Songjiang District Quality and Technical Supervision issued a safety inspection notice to the company, ordering it to stop using the wire rope electric hoist. Despite this, the company continued to operate the equipment for an extended period.
Zhou Moumou and Qian Moumou had been inspecting the company since 2004, but over time, they became less rigorous in their oversight. On August 27, 2010, during an inspection, they discovered the company was using the illegal hoist. However, instead of taking appropriate action, they merely issued a routine inspection report and did not report the violation to the district quality supervision bureau. In subsequent inspections, they failed to enter the production area and only recorded the equipment’s status as normal in their reports.
Due to their negligence, the company continued to operate the unsafe equipment without consequences. This lack of enforcement allowed the illegal use of the hoist to persist, ultimately leading to the tragic accident that resulted in one death. The case highlights the critical importance of proper oversight and accountability in ensuring workplace safety.
