Court mediate pneumoconiosis miners get compensation 210,000

One year after starting coal mining, Luomou was dismissed from his job and his claim for compensation was initially rejected. The court worked hard to find a fair resolution. Recently, the Third Civil Trial Court of Dachang District Court in Dazhou City combined the mass line approach with judicial procedures, quickly resolving a long-standing dispute. They successfully helped a pneumoconiosis worker receive RMB 210,000 in legal compensation, showcasing the effectiveness of civil services. Luomou began working in the Pingtan Township Coal Mine in April 2011. In May 2012, during a routine physical examination, he was diagnosed with a suspected occupational disease. He then sought treatment at several hospitals, including the Central State Hospital, West China Hospital, and the Dazhou Center for Disease Control and Prevention. Eventually, he was officially diagnosed with coal worker’s pneumoconiosis and classified as having a fourth-grade work-related disability by the local labor department. Luomou requested a total of RMB 460,000 in compensation, covering wages during his leave, disability benefits, and other related costs. However, the mine refused to pay, claiming it had no financial resources. Determined to protect his rights, Luomou decided to take the case to court. Despite the legal obligation for the coal mine to compensate him, the reality was that the Pingtan Township Coal Mine had been shut down by the Dachuan District government and was now inoperable, effectively an empty shell with no ability to pay. To ensure justice, the judges spent extra time communicating with both parties, especially the mine’s representatives. They explained the legal responsibilities under the Labor Contract Law, Occupational Disease Prevention and Control Regulations, and Tort Liability Law, while also emphasizing the emotional impact of the illness on Luomou's family. Through persistent persuasion and rational discussion, the mine eventually agreed to compensate Luomou. However, the challenge remained—since the mine had no funds, the judge suggested using the government’s closure compensation fund to cover the loss. On June 18, 2014, after four hours of mediation, both sides reached a settlement: the coal mine agreed to pay Luomou RMB 210,000 in compensation. The agreement brought relief to Luomou, who had been struggling for years. From the moment the case was filed to its final resolution, the Dachuan District Court demonstrated its commitment to resolving complex labor disputes, protecting the rights of workers, and reducing litigation costs. This case not only highlighted the court’s dedication to serving the people but also reinforced its reputation for fairness and transparency. It served as a powerful example of how the judiciary can make a real difference in the lives of ordinary citizens.
