One year after being employed in coal mining, Luomou was diagnosed with pneumoconiosis and his claims were initially denied. Despite the workers' significant demands, the courts made every effort to mediate a final settlement. Recently, the Third Civil Trial Court of Dachang District Court in Dazhou City integrated the mass line approach with judicial proceedings, swiftly resolving a dispute involving an employee suffering from pneumoconiosis. The court successfully helped Luomou receive RMB 210,000 in compensation according to legal standards, showcasing new efficiency in civil service.
Luomou, from Pingtan Township in Dachuan District, worked at the Pingtan Township Coal Mine starting in April 2011. In May 2012, during a routine health check-up, he was found to have a suspected occupational disease and was later dismissed. He then sought treatment at several hospitals, including the Central State Hospital, West China Hospital, and Dazhou Center for Disease Control and Prevention. Eventually, he was officially diagnosed with coal worker's pneumoconiosis and was classified as having a fourth-grade work-related disability by the local labor department.
Luomou requested a total of RMB 460,000 in compensation, covering lost wages, disability benefits, and other related costs. However, the mine refused to pay, citing financial difficulties. To protect his legal rights, Luomou decided to file a lawsuit against the Pingtan Township Coal Mine.
It was revealed that Luomou had developed pneumoconiosis after just one year of work at the coal mine. Following the work injury identification, the mine was legally obligated to provide compensation. However, the Pingtan Township Coal Mine had been shut down by the Dachuan District government and was now non-operational, essentially an empty shell with no ability to pay.
To ensure that Luomou could receive the compensation he was entitled to, the judges spent extra time communicating with both the plaintiff and the defendant. They explained the legal obligations under the Labor Contract Law, Occupational Disease Prevention and Control Regulations, and Tort Liability Law. Through careful persuasion and rational discussions, the defendant eventually agreed to compensate Luomou for his losses.
Despite this progress, the challenge remained: the coal mine had no funds to pay. To resolve this, the court advised the plaintiff and his representative to prepare a detailed compensation list and reach a mutual agreement. Both parties ultimately agreed to use the government’s closure compensation fund for the coal mine to cover Luomou’s losses.
On June 18, 2014, after four hours of mediation, the two sides reached a settlement. The coal mine voluntarily compensated Luomou with RMB 210,000. After years of struggle, Luomou finally smiled, relieved and grateful. From the moment the case was filed to its conclusion, the Dachuan District People's Court successfully mediated this high-risk labor dispute, which had involved multiple complaints and appeals. This resolution not only protected the rights of both parties but also reduced litigation costs and achieved excellent social and legal outcomes. It further reinforced the image of the Dachuan District Court as a judiciary that serves the people, remains close to them, and upholds justice.
